Do I need a permit to replace an existing fence?

At what point is the 25 feet from an intersection measured from?
The curb or right-of-way?

If you are replacing pickets and repairing existing fence, you do not need a permit/ if you take down the fence and rebuild a fence, you will need a permit // the 25 feet measurement is taken from the right of way, not the curb (see UDC) thanks

How far from the curb/street does our fence need to be? We have a privacy fence that sits 25 ft from the curb. We would like to move it closer to the curb and increase the size of our backyard.

Fences can be placed on the property line provided there is not a drainage easement. When you submit for a permit you will include a copy of your survey indicating where you would like to place the fence.

My home is in the middle of two homes I share the fence of three homes, I would like to replace some of the fence since they are starting to be brittle and break easily. Should my neighbours all chip in and share the cost? If not, can I erect a new fence around the existing fence all facing my side on my property line?

You can try to get the neighbors to pitch in but there is no guarantee they will. If they don’t you can put a new fence facing in as long as it is on your property. You will need a permit a permit and yes you can bump it up to the front of your house, if your HOA doesn’t have any problems with it. The HOA and the City have to approve it

I am thinking of replacing my existing 6 ft privacy fence with an 8 ft . Is a permit required and is there height limitations.

Lacie H. | September 3rd, 2010 at 3:35 pm

Yes, a permit is required, even if you are replacing a fence. The maximum height is 8 ft. You will need to fill out
a Miscellaneous Residential Additions form and you will also need to turn in two copies of your plot plan
highlighting where the fence is. If you need anymore information contact Inspection Services at (512) 930-2550.
